Welcome to use AI Plant Identifier - Care (hereinafter referred to as “the Application”). To clarify the rights and obligations between you and the operator of the Application (hereinafter referred to as “we”) during your use of the services, and to protect the legitimate rights and interests of both parties, please carefully read and fully understand this AI Plant Identifier - Care User Agreement (hereinafter referred to as “this Agreement”) before using the Application.
Your use of the Application shall be deemed that you have fully read, understood and agreed to accept all contents of this Agreement. If you do not agree to any terms herein, please stop using the Application immediately.
1. User Rights and Obligations
Rights
1. Users shall have the right to use various functions and services provided by the Application on the premise of complying with this Agreement and relevant laws and regulations.
2. Users shall have the legitimate rights to process their personal data generated in the Application, including the right to access, correct and delete their personal data.
Obligations
When using the services of the Application, you must strictly abide by laws and regulations, and are prohibited from engaging in any illegal or irregular activities through the Application, including but not limited to:
1. Accessing, tampering with or damaging the system data of the Application or other users’ data without authorization;
2. Distributing viruses, malware, spam or other content that endangers the security of the Application or interferes with the normal use of other users;
3. Engaging in fraud, pyramid schemes, money laundering or other illegal and criminal activities through the Application;
4. Violating any applicable laws, regulations, regulatory provisions or industry standards.
2. Data Processing
We do not collect any data generated during your use of the Application, including but not limited to intermediate and result data from plant identification and plant diagnosis.
3. Disclaimer
The plant identification results, plant diagnosis results and related care suggestions provided by the Application are for reference only.
Without limitation, we do not warrant that the Application will meet your requirements, that its operation will be uninterrupted, secure or error-free, or that the results obtained from using the Application will be absolutely accurate or reliable.
4. Modification, Suspension or Termination of Services
4.1 Modification of Services
For reasons including business development, technical upgrades and adjustments to laws and regulations, we reserve the right to adjust or optimize the content, functions and performance of the services. We may also update these terms and conditions irregularly. Therefore, you are advised to check this page periodically for changes. We will notify you of relevant changes by posting new terms and conditions on this page. If you do not agree to the changes, please stop using the services immediately.
4.2 Suspension or Termination of Services
We may suspend or terminate the services without liability under the following circumstances:
- Services cannot be provided normally due to force majeure, including natural disasters, war, government actions, cyberattacks, system failures, etc.;
- You breach this Agreement or engage in illegal activities, and we take measures to suspend services in accordance with the Agreement;
- Necessary maintenance, upgrade or debugging is performed to maintain system security and stability;
- Other circumstances stipulated by laws and regulations.
5. Dispute Resolution
The execution, effectiveness, performance and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China (excluding the laws of Hong Kong, Macao and Taiwan regions). Any dispute arising from this Agreement shall be settled through friendly negotiation first. If no agreement can be reached through negotiation, either party may file a lawsuit with the people’s court having jurisdiction.
6. Other Provisions
1. If any provision of this Agreement is held invalid or unenforceable, the validity of the remaining provisions shall not be affected. We will adjust the invalid provision in accordance with applicable laws.
2. No failure by us to exercise any right under this Agreement shall constitute a waiver of such right.
